SkyDog GPS Terms of Use

These Terms of Use (“Terms”) are an agreement between you and SkyDog (“SkyDog,” “we,” “us”) covering the SkyDog GPS app on iOS and the web app at skydoggps.com (together, “the app”). By using the app you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the app.

The short version: SkyDog GPS shows maps and public data to help you plan adventures. It is informational only — it is not a navigation instrument, not an aviation authority, not a survey, and not an emergency service. The outdoors is dangerous; you are responsible for your own decisions, and you use the app at your own risk.

1. The outdoors is dangerous — assumption of risk

SkyDog GPS is made for activities that carry real risk of injury or death: hiking, boating, kayaking, wave running, snowmobiling, ORV and motorcycle riding, fishing, hunting-country scouting, beach days, and drone flying. You accept those risks. Maps, trails, depths, closures, weather, and every other piece of data in the app can be wrong, incomplete, or out of date. GPS positions and recorded speeds, distances, and elevations are estimates. Always use your own judgment, carry appropriate equipment, check official sources and conditions, tell someone where you are going, and obey posted signs, local rules, and the law. Never let an app substitute for common sense, training, or official information.

2. Not for navigation

Nothing in the app is a navigation product. NOAA chart imagery and all lake-depth and bathymetry data are for general reference only and must not be used for vessel navigation. Depths shown are historical survey values that may not reflect current conditions, water levels, or hazards. Use official, up-to-date charts and your own observations on the water.

3. Drone features are advisory only

Drone Mode displays the FAA’s public UAS Facility Map data and public weather data as an informational convenience. It is advisory only. SkyDog is not an FAA-approved UAS Service Supplier, does not issue airspace authorizations, and submits nothing to the FAA on your behalf. Airspace data may fail to load, lag, or be wrong, and the app’s readouts do not include TFRs, NOTAMs, or local restrictions. As the pilot, you are solely responsible for complying with all applicable law — including 14 CFR Part 107 or the recreational-flyer rules (49 U.S.C. § 44809), obtaining any required authorization through an FAA-approved service, and checking TFRs, NOTAMs, weather, and local rules before every flight. If the app shows no data for a spot, that never means the sky is clear.

4. Trail, closure, and discovery data

Trail networks, closure flags, and points of interest come from government open-data services and OpenStreetMap and may be outdated or wrong. A trail shown open may be closed, private, or impassable. Posted signs and official announcements always win. Riding areas, and access rules change seasonally — verify before you go.

5. Property lines

The Property Lines layer displays parcel boundaries and owner information exactly as they appear in public county records, supplied by a licensed data provider. Boundaries are approximate and are not a survey; records can lag sales and contain errors. This information is provided for lawful recreational and land-awareness purposes only. You may not use it to harass, stalk, threaten, or solicit anyone, or for any unlawful purpose. Always get permission before entering private land. Property owners may request suppression of their record as described in our Privacy Policy.

6. Buddy Trips is not an emergency service

Buddy Trips shares live locations between people who share a trip code. It is not an emergency, safety, rescue, or monitoring service, has no connection to 911 or any dispatch service, and must never be relied on to locate a person in danger. Location updates can stop at any time (no signal, dead battery, closed app). In an emergency, call 911. You may only share a trip code with people you trust, and you may only track a person or device with that person’s knowledge and consent. Tracking someone without consent may violate the law and is strictly prohibited.

7. Subscriptions and purchases

The core app is free. SkyDog All Access is an optional auto-renewing subscription ($4.99 per month in the U.S., or $44.99 per year; or your local App Store price) that unlocks the feature packs included in All Access and removes advertising from the app. It renews at the end of each billing period until cancelled. On iOS, payment is charged to your Apple ID and you can cancel anytime in Settings → your name → Subscriptions; Apple’s refund policies apply. Web purchases are processed by Stripe and can be cancelled from your receipt link or by emailing us. Legacy one-time Fishing Pack purchases remain honored. The free version of the app is supported by advertising. An active All Access subscription removes those ads; if the subscription lapses, the ads return. Legacy one-time pack purchases unlock their features but do not remove ads. Unlock codes are licenses, not property, expire on their stated schedule, and may not be resold.

8. Your license and acceptable use

We grant you a personal, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes. You may not scrape, bulk-extract, or resell app data; probe, overload, or attack the app or its services; misrepresent yourself in a Buddy Trip; or use the app in violation of any law. GPX files you export are yours. Map data belongs to its providers (© OpenStreetMap contributors and others) and is subject to their licenses. All trademarks, including third-party app names mentioned for compatibility, are the property of their respective owners.

9. Disclaimer of warranties

THE APP AND ALL DATA IN IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA WILL BE CURRENT OR CORRECT.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKYDOG AND ITS OWNER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE, ARISING FROM OR RELATED TO YOUR USE OF THE APP OR RELIANCE ON ITS DATA. OUR TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF $50 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

11. Indemnification

You agree to defend and hold harmless SkyDog and its owner from claims arising out of your use of the app, your outdoor or flight activities, your violation of these Terms, or your violation of any law or third-party right.

12. Apple

For the iOS app, these Terms are between you and SkyDog, not Apple. Apple has no obligation to provide support or maintenance and is not responsible for any product claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not in an embargoed country or on a restricted-parties list.

13. Changes, termination, and general

We may update the app and these Terms; the effective date above changes when we do, and continued use means acceptance. We may suspend or terminate access for violation of these Terms. These Terms are governed by the laws of the State of Michigan, USA, without regard to conflict-of-law rules, and disputes will be brought in the state or federal courts located in Michigan, except where your local consumer law provides otherwise. If any provision is unenforceable, the rest remain in effect. These Terms plus the Privacy Policy are the entire agreement.
